Law Talk explores important legal and societal questions about violence and sexual offences. The event addresses two central topics through presentations and discussions.
Topic 1: Protection Against Domestic Violence
How should family law handle cases where the child's best interests, the right to family life and protection against violence intersect? Drawing on international human rights conventions, particularly the Istanbul Convention, the presentation outlines the requirements that apply to Danish authorities. Focus is placed on independent risk assessments and the practical challenges facing family law.
Topic 2: Consent-Based Rape Provisions
The consent-based rape provision was introduced in 2021. The presentation features current research on how this provision functions in practice within the police and court system, and what protection it offers against physical, psychological violence and sexual offences. Based on new research, questions are raised about whether the current criminal protection is sufficient and how protections can be strengthened.
